So you are saying that you want terrorists to have rights? The "little thing called the constitution" is a little flawed. A person can sue for some BS reason and win. A witness can lie thanks to a little payoff causing the defendent to win. So if that can happen in normal civil cases why should the terrorists be allowed to have freedom.
On that note, terrorists still wont have any freedom. They would be trial in a military tribunal with everything going against them. Either way its what they deserve. They are responsible for hijacking their religion and shaping it in their own will.
